TINY UBERZZ

PRIVATE TRANSPORTATION AGREEMENT, TERMS & CONDITIONS, LIABILITY WAIVER, AND RELEASE

 

Effective Date: February 9, 2026
Jurisdiction: State of South Carolina
Applicable Localities: Columbia, SC and Lexington County, SC

 

1. NATURE OF SERVICE (PRIVATE TRANSPORTATION)

Tiny Uberzz (“Company,” “we,” “us,” “our”) is a private, pre-arranged transportation service and is not a rideshare platform, taxi service, common carrier, or public transportation provider.

All services are:

  • Pre-requested

  • Privately accepted

  • Discretionary

  • Subject to availability and payment confirmation

Submission of a request does not constitute acceptance of service.

 

2. ASSUMPTION OF RISK

By requesting, accepting, or participating in transportation services provided by Tiny Uberzz or its independent drivers, you knowingly and voluntarily assume all risks, including but not limited to:

  • Vehicle accidents

  • Traffic conditions

  • Road hazards

  • Weather conditions

  • Acts of third parties

  • Mechanical failures

  • Delays

  • Injuries (minor, serious, or fatal)

  • Property loss or damage

You acknowledge that transportation involves inherent risks, whether foreseeable or unforeseeable.

 

3. FULL WAIVER, RELEASE, AND COVENANT NOT TO SUE

To the maximum extent permitted by South Carolina law, you irrevocably waive, release, discharge, and covenant not to sue:

  • Tiny Uberzz

  • The business owner(s)

  • Independent contractor drivers

  • Agents, representatives, and affiliates

  • Vehicle owners

  • Insurers (personal or commercial)

for any and all claims, including but not limited to:

  • Personal injury

  • Wrongful death

  • Emotional distress

  • Property damage

  • Negligence (ordinary or alleged)

  • Contractual disputes

  • Statutory claims

  • Tort claims

  • Insurance claims

  • Third-party claims

This waiver applies to past, present, and future claims, whether known or unknown, suspected or unsuspected, from the beginning of time through 100 years into the future, to the fullest extent legally enforceable.

 

4. NO CLAIMS AGAINST INSURANCE / NO REACH-THROUGH

You expressly agree that:

  • You waive any right to make a claim against any personal or commercial insurance policy associated with the vehicle or driver.

  • You will not pursue subrogation, contribution, indemnification, or reimbursement from any insurer.

  • You will not attempt to pierce corporate, personal, contractual, or insurance protections under any theory of law.

 

5. INDEMNIFICATION & HOLD HARMLESS

You agree to defend, indemnify, and hold harmless Tiny Uberzz and all related parties from any claims, demands, damages, costs, or attorney’s fees arising out of:

  • Your conduct

  • Your request or use of services

  • Claims made by passengers you invite or accompany

  • Any third-party claims arising from your ride

This obligation survives the completion of the ride.

 

6. PAYMENT TERMS (STRICT)

  • Accepted payment methods: Cash, Cash App, Apple Pay, Zelle

  • Payment is required prior to vehicle movement

  • Submission of payment constitutes acceptance of all policies

  • No service is rendered until payment is confirmed

Stops Policy

  • Additional stops: $5 per stop

  • Maximum stop time: 5 minutes per stop

  • Extended stops may result in additional charges or ride termination

 

7. RIGHT TO REFUSE OR TERMINATE SERVICE

Tiny Uberzz reserves the absolute right to:

  • Decline any request

  • Terminate service at any time

  • Refuse service for safety, conduct, payment, or policy violations

No refund is required for terminations resulting from passenger conduct.

 

8. NO WARRANTIES

Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied.

 

9. DISPUTE RESOLUTION & GOVERNING LAW

  • All disputes shall be governed exclusively by the laws of the State of South Carolina

  • Venue shall lie exclusively in Lexington County, South Carolina

  • You waive any objection to jurisdiction or venue

 

10. SEVERABILITY

If any provision is held unenforceable, the remaining provisions shall remain in full force and effect.

 

11. BINDING EFFECT

This agreement is binding upon:

  • You

  • Your heirs

  • Executors

  • Administrators

  • Legal representatives

  • Assigns

 

12. ACCEPTANCE BY CONDUCT

By:

  • Sending a ride request

  • Making payment

  • Entering the vehicle

You confirm that you:

  • Have read this agreement

  • Understand its terms

  • Voluntarily agree to be legally bound

  • Waive substantial legal rights knowingly and intentionally
